Agreement between Client & Toghi
Welcome to Toghi website (the “Website”). This Website is provided merely to help customers in collecting travel-related information, determining the availability of travel-related goods and services, making legal and authentic bookings or otherwise transacting business with travel suppliers, and for no other purposes. The words "we", "us", "our" refer to Toghi. The word "you" refers to the client visiting the Website and/or make booking through us on this Website, or through our Customer Service Team.
This Website is offered to you conditional upon your approval without amendments of all the terms, conditions, and notices set forth below (collectively, the "Terms of Use” or "Agreement"). Please read the Terms of Use carefully, as they contain significant information about limitations of liability and resolution of disputes through arbitration rather than in court. You should also read our Privacy Policy, which also governs your use of the Website, and is incorporated by reference in this Agreement. By using this Website or contacting our Customer Service Team for the purpose of booking any travel-related services or products offered on the Website, you are deemed to agree that the Terms of Use then by force shall apply. If you do not agree to the Terms of Use, please do not use or book any service through this Website or our Customer Service Team.
Use of the Website
As a condition of your use of this Website, you warrant that:
1. you are at least 18 years old;
2. you have the legal authority to create a binding legal obligation;
3. you will utilize this Website in accordance with these Terms of Use;
4. you will only use this Website to make legitimate bookings for you or for another person for whom you are legally authorized to act;
5. you will inform such other individuals about the Terms of Use that apply to the bookings you have made on their behalf, including all rules and restrictions applicable thereto;
6. all information provided by you on this Website is right, accurate, up-to-date and complete; and
7. if you have a Toghi account, you will protect your account information and will be responsible, to the extent within your reasonable control, for any use of your account by you and anybody other than you.
We have the right at our sole discretion to deny access to any user to this Website and the services we offer, at any time and for any reason, including, but not limited to, for violation of these Terms of Use.
1.Definitions
"Platform" means the website and mobile apps on which the Service (as defined hereunder) is made available, possessed, controlled, managed, maintained and/or hosted by Toghi
"Service" means the online booking service (including the facilitation of payments) of several services now and then made available by Suppliers (as defined hereunder) on the Platform.
"Supplier(s)" means the provider of a service or an accommodation (e.g. hotel, motel, apartment, bed & breakfast), (theme) parks, attractions, museums, sightseeing tours, cruise, rail and coach tours, transfers, tour operators, insurances, and any other travel or related service or product now and then made available for booking on the Platform.
"Website" means www.toghi.com website.
2. Scope of our Service
Through the Platform, (Toghi and its associate (distribution) partners) provide a web platform through which Suppliers can promote their service for booking, and through which visitors of the Platform can make such bookings (i.e. the booking service). By making a booking through the Platform, you are deemed to enter into an immediate and legally binding contractual relationship with the Supplier with which you make a booking or purchase a service or product (as applicable). From the point at which you make your booking, we act solely as an intermediary between you and the Supplier, transmitting the information of your booking to the related Supplier(s) and sending you a booking confirmation voucher via email for and on behalf of the Supplier(s).
When rendering our Service, the information that is shown on the website is based on the information provided to us by Suppliers. As such, the Suppliers are given access to an extranet through which they are completely responsible for updating all rates, availability and other information which is shown on our Platform. Although we will use reasonable skill and care in providing our Service, we will not confirm if, and cannot warrant that, all information is accurate, complete or true, nor can we hold any responsibility for any faults (including obvious and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our Platform or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each Supplier stays accountable always for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) shown on our Platform.
Our Service is made available for individual and non-commercial use only. Therefore, you are not permitted to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content material or information, software, bookings, tickets, products or services found on our Platform for any commercial or competitive activity or purpose.
3. Prices
The prices shown on our Platform are quite competitive. All prices are shown including VAT/sales tax and all other taxes (subject to change of such taxes), unless mentioned otherwise on our Platform or the in the confirmation voucher or ticket. Ticket prices are per person or group and subjected to validity as shown on the ticket, if applicable. Applicable fees and taxes including tourist or city tax (if any) should be paid directly at the hotel (accommodation), such a tax may be charged by the Supplier in the case of a no-show or cancellation fee. Applicable taxes may be charged by the accommodation in the case of a no-show or cancellation fee.
Sometimes cheaper rates are available on our Platform for a particular stay, product or service, however, these rates made available by Suppliers may hold special restrictions and conditions, for instance, non-cancellable and non-refundable. Please check the relevant service and booking conditions and details carefully for any such conditions prior to making your bookings.
The currency converter is for information purposes only and should not be counted on as accurate and real-time; actual rates might alter.
Unintentional mistakes and errors (including misprints) are not binding.

5. Supplier terms and conditions
Additional terms and conditions will be applied to your bookings and purchase of travel-related services that you make. Please read these additional terms and conditions carefully. In specific, if you have purchased an airfare, please make sure you read the full terms and conditions of carriage issued by the Supplier, which can be found on the Supplier’s website. You agree to abide by the terms and conditions of the provided service supplier, including, but not limited to, payment of all amounts when due and compliance with the supplier's terms and conditions regarding availability and use of fares, products, or services. Airfare is only warranted once the purchase has been completed and the tickets have been issued. Airlines and other travel suppliers may alter their prices without prior notice. We reserve the right to cancel your booking if full payment is not received in a timely manner.
Toghi disclaims any liability or legal responsibility for any communication with the Supplier on or through its platform. You cannot derive any rights from any request to, or communication with the Supplier or (any kind of) acknowledgement of receipt of any communication or request. Toghi cannot warrant that any request or communication will be (properly and timely) received/read by, complied with, implemented or acknowledged by the Supplier.
Toghi may offer customers the opportunity to book a flight for a combination of two one—way tickets instead of a roundtrip ticket. Combined one-way tickets may provide a better choice of flights, are often cheaper and can be combined on a similar airline or on different airlines. Unlike roundtrip tickets, each one-way ticket is subject to its own rules, conditions and fees. If one of these flights is affected by an airline alteration (e.g. cancellation or rescheduling) that causes a customer to make changes to the other flight, the customer will be responsible for any fees incurred for making changes to the unaffected flight.
You acknowledge that some third-party providers offering particular services and/or activities may ask you to sign their liability relinquishment prior to participating in the service and/or activity they offer. You understand that any infringement of any such supplier's rules and conditions may result in cancellation of your booking(s), in your being denied access to the applicable travel product or services, in your forfeiting any monies paid for such booking(s), and/or in our debiting your account for any costs we incur as a result of such infringement. Toghi is not responsible for any costs incurred due to accommodation relocation.
6. Credit card or bank transfer
If relevant and available, certain Suppliers offer the chance for bookings to be paid (wholly or partially and as stated under the accommodation remarks in the passenger details page) to the Supplier during the reservation process by means of secure online payment (all to the extent offered and supported by your bank). For particular services and products, Toghi facilitates (through third-party payment processors) the payment of the applicable service (i.e. the payment facilitation service) at the selection of the Supplier (Toghi never acts nor operates as the merchant of record).
For certain (i.e. non-refundable) rates or special offers, please note that Suppliers may require that payment is made by credit card or debit card, and therefore your credit card may be pre-authorized or charged (sometimes without any choice for refund) upon making the booking. Please check the booking details of your product or service of choice thoroughly for any such circumstances prior to making your booking. Toghi will not be liable or responsible for any (authorized, (allegedly) unauthorized or untrue) charge by the Supplier and will not (re)claim any amount for any valid or authorized charge by the Supplier (including for pre-paid rates, no-show and chargeable cancellation) of your credit card or debit card.
In the occurrence of fraud or unauthorized use of your credit card by third parties, most banks and credit card companies bear the risk and cover all the charges resulting from such fraud or misuse, which may sometimes be subjected to deductibility.
7. International Travel
You are liable for making sure that you meet foreign entry requirements and that your travel documents, such as passports and visas (transit, business, tourist, and otherwise), are in order and any other foreign entry requirements are met. Toghi has no specific knowledge about foreign entry necessities or travel documents. We advise our customers to review travel prohibitions, notices, advertisements, and advisories issued by the related governments prior to booking travel to international destinations.
Passport and Visa: You must consult the related Embassy or Consulate for this information. Requirements may alter and you should check for very recent information before booking and departure. We accept no liability if you are refused entry onto a flight or into any country due to your failure to carry the correct and appropriate passport, visa, or other travel documents required by any airline, authority, or country, including countries you may just be transiting through. This includes all stops made by the aircraft, even if you do not leave the aircraft or airport.
Health: Recommended vaccinations for travel may change and you should check with your doctor for current recommendations before your departure. It is your responsibility to make sure that you meet all health entry requirements, obtain the recommended vaccinations, take all recommended medicine, and follow all medical advice regarding your trip.
By offering reservations for travel services in certain international destinations, Toghi does not represent or guarantee that travel to such areas is advisable or risk-free, and is not responsible for compensations or losses that may result from travel to such areas.
8. Bank and credit card fees
Some banks and credit card companies apply fees for international transactions. If you are making a booking from outside Jordan using a Jordanian credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different amount than the amount shown on the billing summary page for a booking made on our Website. Furthermore, a foreign transaction fee may be assessed if credit card issuer bank is located outside Jordan. Booking international travel may be considered to be an international transaction by the bank or card provider, since Toghi may pass on your payment to an international travel supplier.
9.Prepayment, cancellation and no-show policy
By making a booking with a Supplier, you accept and agree to the applicable cancellation and no-show policy of that Supplier, and to any further terms and conditions of the Supplier that may apply to your visit or stay including for services rendered by the service provider. The general cancellation and no-show policy of each Supplier is made accessible on our Platform on the summary page (Remarks section), during the booking process and in the confirmation voucher or ticket (if applicable). Please note that certain rates or special offers are not cancellable or changeable. Applicable city or tourist tax may still be charged by the Supplier in the case of a no-show or charged cancellation. Please check the booking details of your product or service of choice carefully for any such conditions prior to making your booking. Please note that a booking which requires down payment or (wholly or partially) prepayment may be cancelled (without prior notice of default or warning) insofar the relevant (remaining) amount(s) cannot be collected in full on the relevant payment date in accordance with the relevant payment policy of the Supplier and the booking. Cancellation and prepayment policies may vary according to Supplier policies. Please read thoroughly all-important information in your booking confirmation for additional policies as may be applied by the Supplier (e.g. with respect to age requirement, security deposit, non-cancellation/additional supplements for group bookings, extra beds/no free breakfast, pets/cards accepted). Late payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds are for your own risk and responsibility and you shall not be entitled to any refund of any (non-refundable) prepaid amount unless the Supplier agrees or allows otherwise under its (pre)payment and cancellation policy.
If you have a late or delayed arrival on the check-in date or only arrive the next day, make sure to promptly communicate this with the Supplier so they know when to expect you to avoid cancellation of your booking or charge of the no-show fee. Our Customer Service Team can sometimes assist you, depending on the circumstances of each case and without guarantee of any kind if needed with informing the Supplier. Toghi does not accept any liability or responsibility for the consequences of your delayed arrival or any cancellation or charged no-show fee by the Supplier.
10. Liability Disclaimer
The Information, Software, Products and Services shown on this Website may include inaccuracies or errors, including pricing errors. Particularly, Toghi does not warrant the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to the information and description of the accommodation, airline, car rental and other travel services available on this Website (including, without limitation, the prices, photos, list of accommodation facilities, general service descriptions, etc.). Furthermore, Toghi explicitly reserves the right to correct any pricing errors on the Website and/or booking made under a wrong price.
Whether or not the Supplier has charged you for your service, or if we are facilitating the payment of the booking made by you, you agree and acknowledge that the Supplier is always responsible for the collection, withholding, remittance and payment of the applicable taxes due on the total amount of the booking to the relevant tax authorities. Toghi is not liable or responsible for the remittance, collection, withholding or payment of the relevant taxes due on the booking made by you to the applicable tax authorities.
Toghi does not act as the merchant of record for any service or product shown on the Platform.
Property ratings shown on this Website are proposed as only general guidelines, Toghi does not warrant the accuracy of the ratings. Toghi and their respective suppliers may make improvements and/or changes on the Website at any time.
Toghi makes no representations about the appropriateness of the information, software, products and services contained on this Website for any purpose, and the inclusion or offering of any products or services on this Website does not constitute any authorization or recommendation of such products or services offered by Travel One Group. All such information, software products, and services are provided “as is” without guarantee of any kind.
Toghi and their respective Suppliers disclaim all warranties and conditions that this Website, its servers or any email sent from Toghi and/or their respective suppliers are free of viruses or other harmful components. Toghi and their respective Suppliers hereby disclaim all warranties and conditions with regard to this information, software, products and services, including all implied warranties and conditions of merchantability, suitability for a certain response, title and non-violation.
The transports, accommodations and other Suppliers providing travel-related services on this Website are independent contractors and not agents or employees of Toghi. Toghi is not responsible for the acts, errors, omissions, representations, warranties, breaches or negligence of Toghi or any such Suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Toghi has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct control, and they have no responsibility for any additional expenses, omissions, delays, re-routing or acts of God, government or authority.
In no event shall Toghi and their respective Suppliers be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use of this Website or with the delay or inability to access, display or use this Website (including, but not limited to, any computer viruses, information, software, linked sites, products and services obtaining through this Website; or otherwise arising out of the access to, display of or use of this Website) whether based on a theory of negligence, contract, tort, strict liability, customer protection laws, or otherwise, and even if the Toghi and/or their respective Suppliers have been advised of the possibility of such damages.
11. Intellectual property rights
Unless mentioned otherwise, the software required for our Services or available at or used by our Platform and the intellectual property rights (including the copyrights) of the contents and information of and material on our Platform are possessed by Toghi, its respective Suppliers or providers.
Toghi exclusively retains ownership of all rights, title and interest in and to (all intellectual property rights of) (the look and feel (including infrastructure) of) the Platform on which the service is made available (including translated content) and you are not entitled to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or otherwise use the content (including any translations thereof and sometimes the customer reviews) or our brand without our express written permission. To the extent that you would (wholly or partially) use or combine our (translated) content or would otherwise own any intellectual property rights in the Platform or any (translated) content, you hereby assign, transfer and set over all such intellectual property rights to Toghi. Any illegal use or any of the above-mentioned actions or behaviour will constitute a material violation of our intellectual property rights (including copyright and database right).
12. Miscellaneous
To the extent allowed by laws of the Hashemite Kingdom of Jordan, these Terms of Use and the provision of our services shall be governed by and construed in accordance with Jordanian law and any dispute arising out of these terms of use and our services shall exclusively be governed by the competent courts in Amman, Jordan.
The original English version of these terms and conditions may have been translated into other languages. The translated version is a civility and office translation only and you cannot derive any rights from the translated version. In the case of a dispute about the contents or interpretation of these terms of use or contradiction or discrepancy between the English version and any other language version of these terms and conditions, the English language version to the extent permitted by law shall apply, predominate and be decisive. The English version is available on our Platform (by selecting the English language). If any provision of these terms of use is or becomes invalid, unenforceable or non-binding, you shall remain bound by all other provisions hereof. In such event, such invalid provision shall nonetheless be enforced to the fullest extent permitted by relevant law.

What type of information we collect from you
We cannot help you book the perfect service without information, so when you use our services there are certain types of information we as a Toghi asks for and this may include the following:
In General: We receive and save any information you enter on our website or provide us in any other way. This contains information that you can be identified through ("personal information"), including your first and last name, telephone number, and email address, and billing information (such as credit card number, cardholder name, and expiration date). We may also ask for information about your hotel name and check-in date and car rental program information. You can choose not to provide information to us, but normally some information about you is required so you can register as a member, book a trip, complete a user profile, sometimes take part in a survey and contest, ask us a question; or make other transactions on our website.
Travel Companion Information: When you make a booking for somebody else through this website, we will ask you to provide us the personal information and travel preferences about that companion. You should obtain the approval of other companions prior to providing us with their personal information and travel preferences, as any access to view or alter their information will be available only through your account.
Information from Other Sources: We also may regularly get both personal and non-personal information about you from associated entities, business partners and other independent third-party supplier and add it to our account data. Additionally, if you sign up for Toghi using your social media account, link your Toghi account to your social media account, or use certain other Toghi social media features, we may access information about you through that social media provider as per the provider's policies. Relying on the privacy settings of you and your friends, we may access information that you provide to a social media provider regarding your particular locations ("Location Data") to provide you with related content. Sharing your details with our customer service team lets us to respond when you need us – including helping you to get the desired service and responding to any inquires you might have about your booking.
· Account administration: Toghi users can make a user account on our website or apps. We utilize the information you provide us to manage this account, allow you to do useful things and make forthcoming bookings easily. You may manage your bookings or other transactions or your personal setting and take advantage of special promotions we offer.
· Marketing activities: We also utilize your information for marketing purposes. These activities may comprise the below:
1. Using your contact information to send you news of travel-related products and services when you make booking with us or create a user account. You can unsubscribe from these marketing communications fast, easily and whenever you want – just click on the "Unsubscribe" link found in each newsletter.
2. Based on the information you provide us, customized offers may be shown to you on the Toghi website, in mobile apps or on third-party websites or apps (including social media channels). These may be offers that you can book directly on Toghi website, or third-party offers or products we believe you might find interesting. Based on information third parties share us with, we aim to make sure that served to you on other websites or apps are Toghi ads as relevant to you as probable.
· Communicating with you: There may be sometimes when we communicate, including by email, by post, by phone or by texting you – which way we choose depends on the contact information you have previously provided us. And we process the communications you send to us. There could be some reasons for this, including:
1.Responding to and managing any requests you want or any booked service you have made.
2.If you have not completed a booking online, we may send you an email with a reminder to continue with your booking. We believe that this an added service which helps you as it lets you to move on with a booking without having to search for services or fill in your reservation details again.
3.When you use our services, we may send you a survey or request a review about your experience with us.
4. We may also send you other materials related to your bookings, such as how to get in touch with Toghi if you need support when you are away, and information that we feel might be helpful to you in planning your trip or getting the best service you could have. We may also send you material related to upcoming bookings or a summary of previous bookings you made through Toghi.
· Market research: We sometimes ask our clients to participate in market research. Any additional personal information that you provide us as part of the market research will be used only with your approval.
· Promotion of a safe and reliable service: In order to build a reliable environment for you, your travel companion, Toghi's business partners and our service partners, we may use personal information for the recognition and prevention of fraudulence and other illegal or undesirable activities. Also, we may use personal information for risk assessment and security purposes, including the authentication of users and bookings.
· Improving our services: We also use personal information for analytical purposes. This is part of our mission to enhance our services and improve the user experience, but can also be used for testing purposes, troubleshooting and to enhance the functionality and quality of our online travel services. The main aim here is to improve and customize our online portal to suit your needs the best, making our website easier and more pleasurable to use.
· During calls with Toghi support team, live listening may be done or calls may be recorded for quality control purposes and training needs. Call Recordings are kept for a fixed period of time and automatically removed, unless Toghi has a legal interest to keep such recording for a longer period (as reasonably needed), including for fraudulence investigation purposes. Any call recordings will be managed in accordance with this Privacy Policy.
·Legal purposes: In some cases, we may need to utilize your information to manage and resolve legal disputes, for regulatory investigations and compliance, or to enforce the terms of use of Toghi online booking service as fairly expected.
To process your information as mentioned above, we count on the below legal bases:
1.Performance of a contract: The use of your data may be necessary to perform the contract that you have with us. For instance, if you utilize our services to make an online booking, we will use your information to carry out our obligation to complete and manage that booking as per the contract that we have with you.

· Suppliers, such as hotel, airline, car rental company, and service providers, who fulfill your travel interests. ·Third-party sellers who provide services on our behalf, including credit card processing, business analytics, customer service, marketing, spreading of surveys and fraud prevention.
